My lawyer and I are on Sun to discuss the violations with the letter and phone violation hearing. If we get paid acct to the NCO, as I go about getting Cap One to stop reporting a pending payment? etc? I would like a delete but I have seen how hard it is for other people and I do not expect things to be easy. lol.

I have the same type of problem with forster and garbus and cap one. I paid settlement on one, have one more to try to settle, now that JCC christensen took the payoff, Forster and Garbus wants payment in full for same acct. would be nice if they could speak english. seems they just want to leach onto the ones trying to do right. the others who do not care get write offs.

I said, "Mr H, I am truly insulted. lol. No, really, I never worked for a CA. I have done plenty of research and have some knowledge of the FCRA and the FDCPA. "

Reply:If cap is reporting a balance, then it seems it has been assigned to NCO, not sold.
I brought up the issue once of an OC being responsible for the actions of an assignee.
Never really got a clear answer.
